Terms of Service

These Terms of Service ("Terms") govern your use of the HookLab AI iOS application ("HookLab", "the app") and the website at hooklab.appxcellence.net, both operated by Appxcellence ("we", "us", "our"). By downloading, installing, or using HookLab, you agree to these Terms. If you do not agree, do not use the app.

1. Acceptance of Terms

You must be at least 13 years old to use HookLab. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and consented to these Terms on your behalf.

If you use HookLab on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of service

HookLab is an iOS app that uses artificial intelligence — specifically Anthropic's Claude AI — to generate "hooks" (short opening lines or scripts) for short-form video content based on a topic you provide. The app includes a curated library of pre-written hooks, generation features (free and paid tiers), and tools to save and organize favorites.

HookLab is provided "as is" and "as available". We may add, modify, or discontinue features at any time. We will not, however, retroactively remove access to features that were specifically part of an in-app purchase you have already made — see Section 6.

3. License to use HookLab

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use HookLab on iOS devices that you own or control, solely for your personal or internal business use. Apple's standard end-user license terms for App Store apps also apply.

5. In-app purchases

HookLab offers optional one-time in-app purchases:

Prices may vary by region based on Apple's tier conversions. All purchases are processed by Apple through your Apple ID. There is no subscription: you pay once and the unlock is permanent on accounts that have made the purchase, restorable via "Restore Purchases" in the app.

Refunds: All sales are final from our side. Refund requests are handled exclusively by Apple, typically within Apple's standard 14-day window (where applicable by EU consumer law) or at Apple's discretion. Submit refund requests at reportaproblem.apple.com.

6. Service availability and changes

We aim for high availability but do not guarantee uninterrupted service. The AI generation feature depends on Anthropic's Claude API; if that service is unavailable, generation will temporarily fail. The bundled hooks library, your saved favorites, and core app features remain usable offline.

If we permanently discontinue HookLab, we will, where reasonably possible, provide users who have purchased Pro or Pro+ Pack at least 30 days' notice and an export option for their saved hooks.

7. AI-generated content: important disclaimers

HookLab generates content using artificial intelligence. AI output is not perfect and can be wrong, misleading, biased, or inappropriate. You are solely responsible for reviewing every generated hook before publishing, recording, or sharing it.

8. Intellectual property

8.1 Your content

You retain ownership of the topics you type into HookLab. As between you and us, you also own the AI-generated hooks produced from your topics, subject to Anthropic's terms regarding Claude output and to the limitations of copyright law as it applies to AI-generated material in your jurisdiction (which is evolving and may limit what is protectable).

You grant us a limited, worldwide, royalty-free license to process your topic text strictly for the purpose of providing the generation service to you. We do not use your topics to train models, advertise, or for any other purpose.

8.2 Our content

The HookLab app, its design, its branding, the curated library of pre-written hooks, the prompts and style frameworks we use to drive the AI, and all related source code remain our exclusive intellectual property. These Terms do not grant you any rights to our trademarks or branding.

9. Privacy

Our handling of information is described in our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimer of warranties

HOOKLAB AI IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR CONTINUOUS AVAILABILITY. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you in full.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL APPXCELLENCE, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF HOOKLAB.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR HOOKLAB WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR IN-APP PURCHASES IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $20.

Nothing in these Terms excludes liability that cannot be excluded under applicable law (for example, liability for gross negligence or willful misconduct).

12. Indemnification

You agree to defend, indemnify, and hold harmless Appxcellence and its officers, directors, and employees from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of HookLab in violation of these Terms, (b) content you publish, record, or share that was generated with HookLab, or (c) your violation of any third party's rights.

13. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-law principles, except that consumers domiciled in another jurisdiction retain the protection of mandatory rules of the law applicable in their country of habitual residence.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved amicably by contacting us at legal@appxcellence.net. If we cannot resolve the dispute within 60 days, it shall be submitted to the competent state or federal courts located in New Castle County, Delaware, USA, subject to mandatory consumer protections of your country of residence.

For consumers in jurisdictions where binding pre-dispute arbitration is unenforceable, this clause shall be construed to permit dispute resolution in the consumer's local courts to the extent required by law.

14. Modifications to these Terms

We may modify these Terms from time to time. If the changes are material, we will notify you through the app or by updating the "Effective date" at the top of this page at least 30 days before the changes take effect. Continued use of HookLab after the effective date constitutes acceptance of the revised Terms. If you do not accept the changes, your remedy is to stop using HookLab.

15. Termination

You may stop using HookLab at any time by deleting the app. We may suspend or terminate your access if you materially violate these Terms (for example, by abusing rate limits or attempting to bypass DeviceCheck). On termination, sections that by their nature survive — including Sections 7, 8, 10, 11, 12, and 13 — will continue to apply.

16. Apple App Store specific terms

You acknowledge that these Terms are between you and Appxcellence, not Apple. Apple is not responsible for the app or its content. In the event of any failure of HookLab to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Miscellaneous

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right is not a waiver. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Appxcellence regarding HookLab and supersede any prior agreements on the same subject matter.
